Terms of Use
Welcome to Zumy. These Terms of Use (“Terms”) govern your use of the Zumy iOS app and any related services (collectively, the “Service”) operated by Zumy (“we”, “us”, “our”) from France. By installing or using Zumy, you agree to these Terms.
1. Acceptance
By creating a Zumy account or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 13 years old to use Zumy. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and accepted these Terms on your behalf. Zumy is not directed at children under 13, and we will delete any account we discover belongs to someone under 13.
3. Your account
You are responsible for:
- providing accurate information when you sign up (a real first name or chosen display name, a valid email if applicable);
- keeping the credentials of your sign-in provider (Apple, Google, or password-based Firebase Auth) secure;
- any activity that occurs under your account, whether or not you authorised it.
Please notify us at tryzumy@gmail.com as soon as you suspect any unauthorised use of your account.
4. Acceptable use
Zumy is a community. You agree not to use the Service to:
- harass, threaten, or bully other people, including via reviews, comments, or direct messages where they exist;
- post hate speech, slurs, or content that targets a person or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected category;
- post illegal content, including content that infringes copyright, defames a person, or violates a third party’s privacy;
- impersonate another person, including artists, public figures, or Zumy staff;
- scrape, crawl, or automate access to the Service, except as expressly permitted in a written agreement with us;
- distribute spam, malware, or content that exists solely to drive traffic to an external destination;
- attempt to circumvent security, rate limits, or moderation tooling, including by creating multiple accounts to evade a ban.
We review reports of content that breaks these rules and aim to respond within 24 hours for content reports submitted through the app’s in-product reporting flow.
5. Your content
You retain ownership of the reviews, ratings, comments, lists, and other content you publish on Zumy (“Your Content”). By publishing Your Content on Zumy, you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce, display, and distribute Your Content within the Service and across the platforms we use to deliver the Service (App Store previews, push notifications, the Zumy website where applicable). This licence exists only so we can show your reviews to the people who follow you and to the rest of the Zumy community. It ends when you delete the content or your account.
You confirm that Your Content is yours to publish and that it does not infringe the rights of any third party.
6. Termination
You may stop using Zumy at any time and delete your account from inside the iOS app (Settings → Account Info → Delete Account). Deletion is immediate and irreversible.
We may suspend or terminate your account, with or without prior notice, if we reasonably believe you have breached these Terms (particularly the Acceptable use section above), or if doing so is necessary to comply with a legal obligation or to protect other users.
7. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or available at any particular time. To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to your use of the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months preceding the claim, or (b) zero (the Service is currently free).
Nothing in these Terms excludes or limits liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be excluded under applicable law.
8. Governing law
These Terms are governed by the laws of France, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Service shall be submitted to the competent courts of France, except where consumer protection law in your country of residence grants you a non-waivable right to bring the claim in your own jurisdiction.
9. Changes to these Terms
We may revise these Terms from time to time. When we do, we will update the Last updated date at the top of this page and, where the changes are material, give notice inside the app. Continued use of the Service after a change takes effect means you accept the revised Terms.
